Regents Policy RP 11.207, Hazardous Materials Management Effective Date: Prior Dates Amended: Oct. 31, 2014 (recodified) Review Date: August 2019 I. Purpose
To set forth policy regarding hazardous materials management and define hazardous materials.
II. Definitions
“Hazardous Materials” means any substance, element, compound, mixture or solution which is now or at any time hereafter in effect becomes defined as a “hazardous waste,” “hazardous substance,” “pollutant,” or “contaminant” under any applicable Environmental Laws, now or hereafter adopted, accomplished, and promulgated pursuant thereto; and asbestos, polychlorinated, biphenyls (“PCBs”), petroleum, and petroleum byproducts, fuel oils, sludge, crude oil or residue, or trichloropropane. See RP 11.207(A) and (B).
III. Board of Regents Policy
A. The university shall comply with applicable federal and state laws, statutes, rules, and regulations relating to the presence, use, transportation, segregation, consolidation, storage, clean-up, remediation, and removal of hazardous materials (“Environmental Laws”). The president may, as deemed appropriate and consistent with applicable Environmental Laws, adopt and implement university policies, guidelines and procedures relating to hazardous materials management.
B. “Hazardous Materials” means any substance, element, compound, mixture or solution which is now or at any time hereafter in effect becomes defined as a “hazardous waste,” “hazardous substance,” “pollutant,” or “contaminant” under any applicable Environmental Laws, now or hereafter adopted, accomplished, and promulgated pursuant thereto; and asbestos, polychlorinated, biphenyls (“PCBs”), petroleum, and petroleum byproducts, fuel oil, sludge, crude oil or residue, or trichloropropane. IV. Delegation of Authority
The president may, as deemed appropriate and consistent with applicable Environmental Laws, adopt and implement university policies, guidelines and procedures relating to hazardous materials management. See RP 11.207(A).
